Staff Analysis of the Legislation

Amend Chapter 2 of Title 21.  Relating to mailing of absentee ballots, any person who knowingly falsifies information so as to vote illegally by absentee ballot or who illegally gives or receive assistance in voting shall be guilty of a felony.  This bill increases the penalties for certain election related offenses involving fraudulent and willful acts to a felony and, upon conviction, shall be sentenced to imprisonment for not less than one nor more than 10 years or to pay a fine not to exceed $100,000 or both.  If force is involved the person shall be guilty of a felony.  Any person who votes or attempt to vote absentee who is not qualified shall be guilty of a felony.
